1. THE PROMOTER
The Promoter is: Southern Water Services Ltd, Southern House, Yeoman Road, Worthing, West Sussex, BN13 3NX.
Prizes will be provided by: National Schools Partnership, a trading division of We Are Futures Ltd, 1 Paris Garden, London SE1 8ND.
2. HOW TO ENTER
2.1. The competition will run from midday Wednesday 8th May 2024 (the “Opening Date“) to 23:59 on Friday 6th December 2024 (the “Closing Date“) inclusive. The Promoter reserves the right to revise this date and extend the period for accepting entries for the competition in the event of circumstances arising beyond its reasonable control.
2.2. All competition entries must be received by no later than 23:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
2.3. To enter the competition, entrants must send in a photo of their Water Protectors Display Board, which must be submitted via photo to: newwave@nationalschoolspartnership.com. Only one entry per person is permitted. Internet access required. No purchase necessary.
The Promoter will not accept:
(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of posting or transmission as proof of receipt of entry to the competition.
2.4. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
2.5. The competition entries will be judged by a panel of judges based on the most water saved and your ‘make one change’ pledge.
3. ELIGIBILITY
3.1. The competition is only open to primary school age children residing in the South East of England, except employees of the Promoter, agents or any third party directly associated with the administration of this promotion and immediate family of any of these groups. Entrants must obtain the consent of their parent or legal guardian to enter the competition when any images of pupils are shown. All entries of entrants who enter the promotion without disclosing (or attempting to conceal) their age and/or do not provide the required parental consent will be deemed invalid. These Terms and Conditions will bind the entrants and any parent or legal guardian who gives their consent.
3.2. In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
3.3. The Promoter will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with;
(d) photocopies and not originals; or
(e) incomplete.
3.4. There is a limit of one entry to the competition per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
3.5. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
3.6. Competition entries cannot be returned.
4. THE PRIZE
4.1. There will be 4 (four) regional winners of the Water Protectors Competition, residing in Southern Water’s clean water supply areas (Kent, Hampshire, Sussex and the Isle of Wight). The 4 (four) winners will receive:
– £1,000 cash prize to be put towards an environmental project
– Branded steel bottles and sticker pack for the whole class
4.2. Prizes are subject to availability. There is no cash alternative for the prize.
4.3. The prize is supplied by the Partner Agency. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
4.4. The prize is not negotiable or transferable.
5. WINNER NOTIFICATION
5.1. The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.
5.2. The winner will be notified in July using the telephone number or email address provided with the competition entry. All reasonable efforts will be made to contact the winner.
5.3. If a winner does not respond within 3 working days of being first notified, then the winner’s prize will be forfeited and the Partner Agency will be entitled to offer the prize to the next eligible entrant selected from the entries that were received before the Closing Date.
5.4. The Promoter does not accept any responsibility if you are not able to take up the prize.
6. LIMITATION OF LIABILITY
6.1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
6.2. Promoter will only receive the personal information of the competition winner and not that of any other entrant.
As required by the Advertising Standards Authority, the surname and county of the prize winner can be obtained by emailing competitions@nationalschoolspartnership.com and quoting “Southern Water – Water Protectors competition 2024”. By entering, the winner consents to such information being disclosed upon request. 7. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
7.1. By submitting your competition entry and any accompanying material, you agree to:
(a) assign to the Promoter all your intellectual property rights with full title guarantee; and
(b) waive all moral rights,
in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
1.2. By submitting your competition entry, you confirm:
(a) Your entry is an original work, is not defamatory and does not infringe third-party rights;
(b) There are no conflicting agreements in place that restrict usage of your entry;
(c) You have consent to use any third-party image/content in your entry and rights have been waived for such use. If a third-party image is of a person under 18, parental or guardian consent has been provided.
(d) You will provide any required consents at the Promoter’s request, failing which the Promoter reserves the right to disqualify you from the competition.
(e) Entrants’ may withdraw from the competition at any time until the determination of the winner by informing the Partner Agency at competitions@nationalschoolspartnership.com. Entrants’ right to get their personal data deleted is set out in the Partner Agency’s privacy notice.
8. DATA PROTECTION AND PUBLICITY
8.1. Entrants’ personal information will only be processed by the Partner Agency as set out in its privacy notice: https://nationalschoolspartnership.com/privacy-policy/.
9. USE OF THE ENTRIES / CONTENT BY THE PROMOTER
9.1. The Promoter may publish Content produced by the winners on any of its websites or social networking websites and all Content received by it in connection with this Competition at any time and for any reason.
9.2. All Participants hereby provide a non-exclusive, royalty-free, irrevocable, perpetual, transferable licence to the Promoter to use the Content submitted for any purpose, including without limitation for advertising the Promoter’s products. The Participant hereby waives all moral rights they have in the Content submitted to the fullest extent permitted by law.
9.3. Each Participant warrants that they are the person who created the Content submitted to this Competition and that all Content adheres to the Content Guidelines. The Participant shall indemnify the Promoter and hold it harmless from and against any losses, damages, liabilities, obligations, claims, actions and demands, including without limitation reasonable legal fees, arising directly or indirectly from any breach of warranty set out in this clause.
10. GENERAL
10.1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
10.2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
10.3. The prize competition will be governed by English law and entrants to the prize competition submit to the jurisdiction of the English courts.
